Terms and conditions of online events

1. Scope

  • 1.1 For the business relationship between The Workademy GmbH – Ehrenbergstrasse 6, 10245 Berlin (hereinafter "Organizer") – and the participants of the online bootcamp (hereinafter "Customers"), the following general terms and conditions (hereinafter "GTC") apply exclusively in their at the time of Order valid version. We do not recognize conflicting, deviating, or supplementary general terms and conditions, nor do they become part of the contract.
  • 1.2 Entrepreneur is a natural or legal person or a legal partnership who, when concluding a legal transaction, acts in the exercise of their commercial or independent professional activity (§ 14 BGB).
  • 1.3 A consumer within the meaning of these terms and conditions is any natural person who concludes a legal transaction for a purpose that can predominantly neither be attributed to their commercial nor their independent professional activity (§ 13 BGB). Participants who take part in the seminars through their employer are not consumers, because it is not they themselves who are contractual partners of the Organizer, but their employer (for example, if the employer books the seminar for its employees).

2. Subject of the Contract

  • 2.1 The Organizer offers online training courses on its platform, which are provided in various forms of teaching and implementation (e.g. as a chat-supported lecture, discussion or workshop, as a live webinar or video course).
  • 2.2 Prices, details, and conditions of the individual events can be found in the respective product description in the online shop.
  • 2.3 Unless otherwise stated, all offers apply “while stocks last”, that is, until the maximum number of participants is reached.

3. Order Process and Conclusion of Contract

  • 3.1 The Customer can register on the website or on a designated third-party site/platform to take part in online training. He must provide his personal data completely and truthfully.
  • 3.2 The Customer will receive the invoice. After the payment, to the email address given when booking, there will be sent the access data for the event. He is obliged to keep this data carefully, not to pass it on to unauthorized third parties, and to protect it from access. The participant is also obliged to keep the data provided, in particular the contact details, up to date.
  • 3.3 After receipt of payment, the Organizer will confirm by email that the order has been completed. Only then is a contract concluded between the Organizer and the participant. The Workademy events (seminars/webinars/bootcamps) listed on the website do not constitute an offer in the legal sense.

4. Cancellation Policy

  • 4.1 Withdrawal from a live online event (webinar, boot camp): You can withdraw free of charge up to 7 working days before the scheduled date. If the booking is canceled later, the participation fee will not be refunded. (If a recording is planned, this will be made available.)
  • 4.2 Withdrawal from a face-to-face seminar: Withdrawal is free of charge up to 2 working days before the registration deadline stated in the seminar description. Thereafter, 100% of the seminar fees are incurred as cancellation costs (if the seminar takes place).
  • 4.3 Instead of canceling, if they are unable to attend, participants can name a substitute who will take over all rights.
  • 4.4 Additional regulations may apply to certain events. Please note the information in the respective offers.

5. Prices and Payment Methods

  • 5.1 The participation and booking fees result from the respective product description and include the applicable statutory sales tax.
  • 5.2 The Customer can choose from the available payment methods before completing the order process.
  • 5.3 If the payment on account is possible, payment must be made immediately upon receipt of the invoice. For all other payment methods, the participation or booking fee must be paid in advance.
  • 5.4 If third-party organizers are commissioned to process payments, their general terms and conditions apply. Fees third party may charge will be stated accordingly.

6. Technical Requirements for Participating in a Live Event

  • 6.1 When participating in a live online event (webinar, boot camp, etc.), each participant is obliged to meet the minimum requirements (internet connection, current browser version, loudspeakers, or headset) and to test them before the webinar.
  • 6.2 The failure of the technical prerequisites for which the participant is responsible does not release them from their contractual obligation to pay. If a participant does not report any technical problems during a webinar and the recording does not reveal such messages, participation is deemed to have taken place.

7. Copyright

  • 7.1 The content of all events and all materials (webinar documents, recordings made available, etc.) are the intellectual property of The Workademy GmbH or the respective speakers and are protected by copyright. They may only be used by the registered participant to whom they were made available. In particular, it is not permitted to publish, reproduce, pass on and edit, even partially, or to record an event in audio or video or using screenshots. Any abuse can be legally prosecuted.
  • 7.2 The participant undertakes to protect the copyrights and to use the live webinars/video courses individually for their own use only within the framework of the contractual agreement.

8. Duration and termination of the contract

The term of the contract is determined by the respective description of the online event. The participant's contractual obligations, in particular the obligation to pay, exist regardless of whether the participant actually attends the booked event.

9. Postponement and cancellation of live webinars

  • 9.1 The Workademy GmbH reserves the right to cancel the events up to 4 working days before the scheduled date if the minimum number of participants is not reached. If the event is canceled for this reason or due to failure of the speaker, force majeure or other unforeseeable events, there is no entitlement to implementation. The participants will be informed immediately in writing or by e-mail. Fees already paid can either be credited or reimbursed for participation in other events. The participants have no further claims against the Organiser.
  • 9.2 If the speaker fails, the Organizer reserves the right to provide an equivalent replacement speaker. In this case, there is no entitlement to a refund of the participation fees.

10. Right of withdrawal

  • 10.1 The following possibility of withdrawal applies in addition to the statutory right of withdrawal for consumers and does not exclude this. The withdrawal applies in particular to business Customers (entrepreneurs) who cannot invoke the right of withdrawal.
  • 10.2 A booked live online event can be canceled in writing (e.g. by email) up to 7 working days before the start of the event against payment of an administration fee of 10% of the participation fee. In the event of a later cancellation, no participation fees will be refunded. The receipt of the notification to the Organizer is decisive in each case.
  • 10.3 “Bootcamp for Online Academies” is an exception to this rule: The right of withdrawal can be claimed within the first Bootcamp week: 7 calendar days after the event started. A processing fee of 200 euros will be retained.

11. Recordings of Online Events/Consent

Workademy events are usually recorded for record-keeping, quality assurance, and training purposes. If so, you will be accordingly informed. Without your consent, no recordings will ever take place.

12. Place of Jurisdiction, Applicable Law, Contract Language

  • 12.1 The place of jurisdiction and place of fulfillment is the seat of the Organiser if the participant is a merchant, legal entity under public law or special fund under public law or has no general place of jurisdiction in Germany or, after the conclusion of the contract, moves his seat or habitual residence out of the scope of the civil procedure code or his seat usual place of residence is not known at the time the action is brought.
  • 12.2 The law of the Federal Republic of Germany. This does not apply if mandatory consumer protection regulations prevent such an application.
  • 12.3 Contract language is English.

13. Online Dispute Resolution

In order to settle disputes between consumers and entrepreneurs about goods or services purchased online out of court, the European Commission has set up a platform for online settlement of consumer disputes ("OS platform").
